US Supreme Court upholds ban on partial birth abortions

The Supreme Court of the United States on Wednesday April 18 has upheld the federal Partial-Birth Abortion Ban Act of 2003. The 5-4 vote reflected the change in vote count resulting from the retirement of Justice O’Connor and the confirmation of Chief Justice Roberts and Justice Alito.

The Intact dilation and extraction procedure, also known as partial birth abortion, involves removing an intact late-term fetus from the womb via the cervix. While it is a relatively rare operation – 0.17% of all abortions in the US in 2000, it has become a focal point in the abortion debate.

The Partial-Birth Abortion Ban Act bans the procedure in cases where the fetus is terminated during the operation, unless it is performed to to save the life of the mother.

Justice Kennedy wrote in the opinion of the court: “respondents have not demonstrated that the Act would be unconstitutional in a large fraction of relevant cases.” Further, he said, “Respondents have not demonstrated that the Act, as a facial matter, is void for vagueness, or that it imposes an undue burden on a woman’s right to abortion based on its overbreadth or lack of a health exception. For these reasons the judgments of the Courts of Appeals for the Eighth and Ninth Circuits are reversed.”

In a concurring opinion, Justice Thomas stated that he joins “the Court’s opinion because it accurately applies current jurisprudence, including Planned Parenthood of Southeastern Pa. v. Casey, 505 U. S. 833 (1992).”

In dissent Judge Ginsburg wrote: “Today’s decision is alarming. It refuses to take Casey and Stenberg seriously. It tolerates, indeed applauds, federal intervention to ban nationwide a procedure found necessary and proper in certain cases by the American College of Obstetricians and Gynecologists.”

Justice Kennedy’s words also recall the complicated issues of standing related to such cases. An issue in Roe v. Wade was the impossibility of any individual having standing in a court proceeding regarding abortion rights, since court proceedings take more than the 9 months of pregnancy, retiring any individual plaintiff’s standing before an appeals process can take place. The criterion of “a large fraction of relevant cases” may effectively deny standing to any plaintiffs who wish to litigate particular restrictions in some relevant future cases.

Many media outlets traditionally deliberately spread hoaxes on April Fools’ Day, including notable quality sources such as National Geographic and Science.

The popular British tabloid The Sun wrote that French President Nicolas Sarkozy is to undergo stretch surgery to make him taller than his wife, Italian artist and model Carla Bruni. The report claimed the 5 foot 5 inch leader would be made 5 inches taller in one year using a method by Israeli professor Ura Schmuck. The Sun noted that during his visit to Britain last week, Sarkozy had high-heel shoes while his wife wore a pair of flat pumps.

The Guardian on the other hand ran an article that suggested that Carla would head an initiative by Prime Minister Gordon Brown to bring more glamour, good taste and sophistication to the U.K. general population. This would involve collaboration with Marks & Spencer for high-street fashion and Jamie Oliver for meals and wine.

BBC News had real-looking footage of flying penguins fronted by documentary host Terry Jones, which were actually an advertisement for its new iPlayer.

Australian–US team of scientists finds Atlantic warming causes Pacific climate trends

A team of scientists from Australia and US has found a solution for a challenging problem in climate research. Climate models predicted more greenhouse gases would weaken the equatorial Pacific trade winds.However, over the past two decades, observations showed this Walker circulation was getting stronger, accelerating sea level rise in the western Pacific, and consequent changes in global climate.The researcher team reports, “The answer to the puzzle is that recent rapid Atlantic Ocean warming has affected climate in the Pacific”.Their study, “Recent Walker circulation strengthening and Pacific cooling amplified by Atlantic warming”, was published on Sunday in Nature Climate Change.

While previous research supposed natural variability alone accounted for cooling in the eastern Pacific, this study highlights a previously overlooked climate feedback: as the Atlantic warms, it alters the winds over the Pacific, depressing the ocean temperature there.As coauthor Shayne McGregor of the University of New South Wales explains, “the main cause of the Pacific wind, temperature, and sea level trends over the past 20 years lies in the Atlantic Ocean […] We saw that the rapid Atlantic surface warming observed since the early 1990s, induced partly by greenhouse gases, has generated unusually low sea level pressure over the tropical Atlantic. This, in turn, produces an upward motion of the overlying air parcels. These parcels move westward aloft and then sink again in the eastern equatorial Pacific, where their sinking creates a high pressure system. The resulting Atlantic–Pacific pressure difference strengthens the Pacific trade winds.”

Coauthor Malte Stuecker of the University of Hawaii Meteorology Department reports that “Our study documents that some of the largest tropical and subtropical climate trends of the past 20 years are all linked: Strengthening of the Pacific trade winds, acceleration of sea level rise [three times faster than the global average] in the western Pacific, eastern Pacific surface cooling, the global warming hiatus, and even the massive droughts in California”. His colleague cauthor Fei-Fei Jin adds, “We are just starting to grasp the scope of the impacts of this global atmospheric reorganization and of the out-of phase temperature trends in the Atlantic and Pacific regions”.Work earlier this year by coauthor Matthew England, University of New South Wales, showed the stronger winds have churned up the waters of the Western Pacific Ocean, so more heat flows from the winds into the water. This appears to explain why global surface temperatures have recently risen more slowly.

Coauthor Axel Timmermann of the University of Hawaii notes a further amplifying effect: “Stronger trade winds in the equatorial Pacific also increase the upwelling of cold waters to the surface. The resulting near-surface cooling in the eastern Pacific amplifies the Atlantic–Pacific pressure seesaw, thus further intensifying the trade winds […] It turns out that the current generation of climate models underestimates the extent of the Atlantic–Pacific coupling, which means that they cannot properly capture the observed eastern Pacific cooling, which has contributed significantly to the leveling off, or the hiatus, in global warming.”As Professor England said, “It will be difficult to predict when the Pacific cooling trend and its contribution to the global hiatus in surface temperatures will come to an end. […] However, a large El Niño event is one candidate that has the potential to drive the system back to a more synchronized Atlantic/Pacific warming situation.”

So far, the news on the U.S. presidential election has been dominated by Republican Party and Democratic Party nominees John McCain and Barack Obama. However, recently, some “third party” candidates have begun to gain notoriety, namely Libertarian Party nominee Bob Barr and independent Ralph Nader.

Unbeknownst to many, there are several other minor party candidates in the race. One of them is New American Independent Party nominee Frank McEnulty. McEnulty has been interviewed several times by Wikinews over the past few months, but in one held earlier this week with reporter Joseph Ford, he went into detail on why he’d be a good president, why its necessary to support a third party candidate this year, and most importantly, why you should give him your vote.

2012 Report on Gender Equality and Development says US women have room for progress

Tuesday, World Bank released the 2012 World Development Report on Gender Equality and Development. The United States is referred to many times, often as a benchmark to foster understanding of recent gains for women in other parts of the globe. At the same time, United States women still lag behind US men in a number of areas.

In 2012, the authors note women in the United States still face challenges economically and socially. They are represented disproportionately in certain professions like teaching and nursing. They are paid less than their male counterparts. Jobs traditionally held by women also result in lower wages for men who hold these jobs. They are under-represented at the highest level of business, with only 28 of Fortune 1000 companies having a female chief executive officer. The bottom 20% of women economically have a slightly higher birth rate than their peers in the top 20%.

Immigrants to the United States from Southeast Asia and India have higher than expected male to female birth ratios, which the report authors suggest is partially deliberate sex selection based on cultural attitudes from home countries. In 2009, over half a million US women were victims of intimate partner violence. The report suggests US men have greater pension assets than US women. When compared to elderly US men, elderly women in the United States are more likely to live alone than with a spouse. US women are disproportionately under-represented in local police forces, accounting for less than 20% of all police officers. Women in the United States also bear a higher percentage of housework duties than men at 61%. When US women take part time work while raising children, they find it difficult to use that work experience to gain future full time employment. US women are disincentivized from re-entering the workforce after giving birth because of the high cost of childcare.

Many of the gains for United States women took place a while ago and took a long time to get. It took 40 years, 1870–1910, to see major improvements in the percentage of girls aged 6 to 12 attending school. In 1921, after women got the right to vote in the United States, the United States Congress passed the Promotion of the Welfare and Hygiene of Maternity and Infancy Act. This assisted in lowering infant mortality from 23% to 15%.

The report says affirmative action in the United States resulted in jobs transferring from men to women, but the authors hedged and did not draw a conclusion about the economic impact of these legislative efforts other than to say the impact was not negative.

Many of the legislative victories for United States women came early compared to developing countries. Property rights for women, while later than some of their European counterparts like Norway and the United Kingdom, started to come by 1848. That year, the Married Women’s Property Act was passed in New York. It was the first legislation of its kind in the country. Other states soon followed. Women got suffrage on a state-by-state level in the country until they got federal suffrage in 1920. Title VII of the Civil Rights Act of 1964 barred discrimination against women and allowed married women to make loans without their husband’s consent. In 1980, airlines were barred from discriminating against flight attendances for their marital status during the hiring and firing stage.

The number of United States respondents agreeing with the proposition “a university education is more important for a boy than for a girl” decreased from about 14% in the period between 1994 and 1999 to about about 9% in the period between 2005 and 2007. Similarly, the number of people who agreed with “when jobs are scarce, men should have more right to a job than women” decreased from 19% to about 8% over the same period.

The report cites current research from the United States and England showing the more education a mother has, the better the outcomes for her children will be.

Currently in the United States, females academically outperform their male counterparts in all academic areas including [[mathematics|math] and science. On the Programme for International Student Assessment math test though, US boys tested better than US girls by a score of roughly 495 to 480. US girls outperform boys on the literacy test with mean scores of approximately 510 to 490. In this regard, the report suggests US girls’ performance patterns resemble global ones.

Mali’s percentage of girls in primary school is equivalent to the United States in 1810 at around 34%. Burkino Faso is worse, matching the United States in 1780 with a percentage of roughly 25%. Niger’s current enrollment for girls is around 50%, around the same percentage as the United States in 1900.

Interview with Reggie Bibbs on his life with neurofibromatosis

Neurofibromatosis (NF) is a genetic condition causing benign tumors (neurofibromas) to grow along certain types of nerves and, in addition, it can affect the development of bones or skin. There are several variants of the disease but type 1 and type 2 NF account for the vast majority of cases.

The disease manifestations can vary from very mild to severe. Major symptoms include growths on and under the skin; skin pigmentations called café au lait spots in type 1; acoustic nerve tumors and consequent hearing loss in type 2. Growths can affect nearly all parts of the body, and pressure on nearby structures can cause a wide variety of complications. There is a small risk that the tumors transform into malignant cancerous lesions.

NF is one of the most common single-gene human diseases; around 1 in 2,500-4,000 live births are affected by NF-1, whereas NF-2 occurs in about 1 in 50,000-120,000. Both type 1 and 2 are autosomal dominant conditions, meaning that only one copy of the mutated gene need be inherited to pass the disorder. A child of a parent with neurofibromatosis and an unaffected parent will have a 50% chance of inheriting the disorder. The gene responsible for NF-1 and possibly NF-2 is thought to function as a tumor suppressor gene.

In most cases of neurofibromatosis 1, patients can live normal and productive lives. In about 25-40% of patients there is an associated learning disability with or without ADHD. In some cases of neurofibromatosis 2, the damage to nearby vital structures, such as the cranial nerves and the brainstem, can be life-threatening. When tumors are causing pain or disfiguration, surgery is thus far the only proven beneficial treatment option.

Reggie Bibbs is a 43-year-old-man living in Houston, Texas. Mr Bibbs was born with a genetic disease called neurofibromatosis (NF), which causes him to develop tumors on his body (see infobox on the right). NF can be a subtle disease, but in Bibbs’ case it has left him with a disfigured face and deformed leg. But he is happy with the way he looks, and doesn’t want to change his appearance to please other people. He has launched a successful campaign entitled “Just Ask”, and that’s just what Wikinews did in a video-interview.

The interview was prepared by Wikinews reporter Michaël Laurent with the help of Bertalan Meskó (who has a popular genetics and web 2.0 blog). Their questions were sent to a close friend of Mr. Bibbs, Lou Congelio, who kindly conducted the interview.

Mass grave with 51 bodies from the Nazi era found in Germany

The decomposed bodies of 22 children ranging from the ages of zero to seven and 29 adults have been found in a mass grave, believed to date back to the 1940s, in a Catholic church cemetery in Menden-Barge, a small village in Germany.

The buried are believed to be victims of Adolf Hitler’s program in which numerous disabled people were murdered.

“We assume that these were victims of the Nazi regime,” state prosecutor Ulrich Maass stated.

At least three of the children’s skeletons’ show signs of being physically handicapped, further supporting the evidence that this was part of the euthanasia program.

While most of the bodies look like they were carelessly tossed in the ground, a few adults were placed in coffins.

Medical instruments were also found in the grave, supporting the possibility that the children were murdered by injections and drug overdoses.

Mr. Maass also noted that authorities would investigate the suspected murders and search for any witnesses. Already, a former church assistant said he saw a horse-drawn cart bring corpses to the mass grave.

Apparently, the town remained silent about the existence of a mass grave until about three years ago when investigations led by the local authorities gave evidence that a mass grave may exist in the cemetery.

Mr. Maass also admitted that, after 61 years from the end of World War II, bringing charges against someone would be a difficulty.
