Eleven killed in train crash in northern Victoria, Australia

Eleven people have been killed, and more than 20 injured, when a V/Line passenger train and a semi trailer collided at a level crossing on the Murray Valley Highway in northern Victoria, Australia. At least 13 more are still missing and are believed to be trapped in the wreckage.

The collision, which occurred at 1:40 p.m. local time, was approximately 10 km north of the town of Kerang, on the Swan Hill railway line.

The train involved in the accident was a service from Swan Hill, which departed at 1:00 p.m. from Swan Hill railway station, and was destined for Melbourne. The train was comprised of a locomotive and three carriages.

Witness reports say that the semi-trailer collided into the second of the three carriages, and then detached the third carriage from the remainder of the train and causing it to derail. The whole side of the second carriage was ripped open from the direct impact of the semi-trailer.

The injured have been transferred from the scene to hospitals in the area, including Kerang and Mildura, by ambulance. Helicopters and light aircraft have been used to transfer patients to Melbourne, as local hospitals struggle with the sudden influx of patients. The driver of the semi-trailer has been moved to the hospital in Mildura in “critical condition”, according to police at the scene.

The train had 39 people on board the 1:00 p.m. service, according to train documents. This included three staff employed by the train operator V/Line, who have all been accounted for and are not injured. Of the 36 passengers on the train, it has been reported that 23 have suffered injuries.

Reports say six people were airlifted to Melbourne for treatment, however one has since died. The remaining 17 have been moved to regional hospitals, including the temporary relief centre in Kerang, according to a Rural Ambulance Service spokesperson.

Although there are still 13 people unaccounted for, police say it is possible that some had bought tickets and were therefore listed on the train manifest, but did not end up catching the service.

Premier of Victoria Steve Bracks is expected to fly to the crash scene this evening. He has ordered a full investigation into the incident. Federal Minister for Transport Mark Vaile has offered Federal government assistance from the Australian Transport Safety Bureau to help with the investigation. The Prime Minister John Howard has offered the Victorian government any additional aid that is requires in the aftermath of this incident.

Train operator V/Line have set up an emergency hotline to assist relatives and friends of those on the train receive information. The number is 1800 800 120.

Buffalo, New York —Attorney Arthur J. Giacalone has filed a lawsuit in New York Supreme Court against the city of Buffalo‘s Common Council and Planning board, alleging that the proposed Elmwood Village Hotel was approved “without giving meaningful consideration to either the impact on the adjoining residential neighborhood, or the unique character of this section of Elmwood Avenue.” Giacalone is representing Nancy Pollina and Patricia Morris, who operate the Don Apparel (a vintage clothing and collectibles shop at 1119 Elmwood Avenue), Angeline Genovese and Evelyn Bencinich, owners of residences on Granger Place which abut the rear of the proposed site, Nina Freudenheim, a resident of nearby Penhurst Park, and Sandra Girage, the owner of a two-family residence on Forest Avenue less than a hundred feet from the proposed hotel’s sole entrance and exit driveway.

The Elmwood Village Hotel is a 72-room, seven-million-dollar hotel proposed by Savarino Construction Services Corporation and designed by architect Karl Frizlen of the Frizlen Group. Its construction would require the demolition of at least five buildings, currently at 1109-1121 Elmwood, which house several shops and residents. Although the properties are “under contract,” it is still not known whether Savarino Construction actually owns the buildings. It is believed that Hans Mobius, a resident of Clarence, New York and former Buffalo mayoral candidate, is still the owner. The hotel is expected to be a franchise of the Wyndham Hotels group.

The lawsuit, filed in State Supreme Court, is seeking annulment of the City of Buffalo’s rezoning and site plan approvals for the hotel.

“Had the Common Council members complied with State law and waited to receive comments from the County’s planning agency, they would have been obliged to address the County’s concerns regarding the replacement of former residential buildings with ‘a much larger commercial structure’, the health effects of placing a 55-vehicle parking area next to existing homes, and the absence of a traffic study to assess the likelihood that the project would add ‘considerable congestion’ to the Elmwood/Forest intersection,” said Giacalone.

“The four-story hotel will overshadow the neighboring homes and backyards, impacting quality of life and property values. Equally as important, the project will displace a unique and diverse group of businesses that have served nearby college students and Buffalo’s arts and theater community for many years, and replace them with upscale retail establishments that will cater, not to local residents, but to affluent tourists and business travelers,” added Giacalone.

On March 22, 2006 the city’s Common Council approved the rezoning for the proposed hotel and on March 28, the Planning board approved the design and site plan of the hotel.

The lawsuit, entitled Pollina et al. v. Common Council of the City of Buffalo et al., [Index No. I-2006-3885], has been assigned to the Honorable Rose H. Sconiers, and is scheduled for oral argument at 9:30 A.M. on Thursday June 8, 2006.

Three law enforcement officers shot, one dead along with suspect, in St. Louis, Missouri standoff

Two US Marshals and one officer of the St. Louis, Missouri Metropolitan Police Department were shot during a gunfight while trying to apprehend a suspect on Tuesday morning. All three were taken to local hospitals for treatment, where one US Marshal later died. The suspect, identified by his family as 35-year-old Carlos Boles, was shot and killed by authorities returning fire.

Eight law enforcement officials arrived at Bole’s St. Louis, Missouri home to serve a felony arrest warrant. Upon entering the house, they were fired at with a semi-automatic firearm, according to ABC News. The shooter reportedly said, “I’m only going out in a body bag.” After the shootings occurred, a SWAT team was requested because police did not know whether any other individuals were in the home. Three children, belonging to Bole’s sister, had left the home before police initially moved in around 6:50 a.m. CST (12:50 UTC).

The wounded officer of the St. Louis Police Department was taken to Barnes-Jewish Hospital after being grazed by a bullet that was stopped by his bulletproof vest, and then falling down. A spokesperson for the police department described the officer, who had been with the department for 34 years, as responsive and communicating.

The two injured marshals were taken to St. Louis University Hospital. A statement released by the US Marshals Service said one of the marshals, 48-year-old Deputy Marshal John Perry had died around 7:00 pm CST (01:00 UTC) after being shot in the head. Perry was a ten-year veteran of the US Marshals Service. The other US Marshal, 31-year-old Theodore Abegg, was reported to be in fair condition, shot in the ankle and is expected to survive. Francis Slay, Mayor of St. Louis, talked to the victims’ families at the hospital.

“Our deputies and law enforcement partners face danger every day in the pursuit of justice for the citizens of this great nation,” said Director Stacia A. Hylton of the US Marshals Service. “Our people and our partners are well trained and prepared, but it is impossible to predict when a wanted individual will make a fateful choice that results in the loss of life or injury. When that happens, and the life lost is a law enforcement officer or other public servant, it is an immeasurable tragedy felt by all. Today, unfortunately, we again feel that pain. Our thoughts and prayers are with our fallen deputy as well as the injured and their families.”

The suspect’s sister said he was not returning to jail, in which he had already served ten years. In December, records show Boles pleaded guilty to burglary, armed criminal action and assault charges. He was living in the 3100 block of Osage Street in the St. Louis suburb of Dutchtown. Boles was wanted for assault on a law enforcement officer in the second degree, three counts of possession of a controlled substance, and resisting arrest. The FBI is now conducting the investigation, per standard procedure.

Pakistani schoolgirl Malala Yousafzai discharged from hospital

The Pakistani schoolgirl Malala Yousafzai, who was shot by the Taliban for campaigning for education for girls, was discharged yesterday from the Queen Elizabeth hospital in Birmingham, England after success in the first stage of her medical treatment.

In October, Yousafzai was shot by Taliban forces on a school bus in Mingora, Swat District, Pakistan. She was given emergency treatment in Pakistan and then flown to Britain for treatment at a specialist unit which deals with injured soldiers.

Dave Rosser, University Hospitals Birmingham NHS Foundation Trust medical director, gave a statement about Yousafzai’s release from hospital: “Malala is a strong young woman and has worked hard with the people caring for her to make excellent progress in her recovery. Following discussions with Malala and her medical team, we decided that she would benefit from being at home with her parents and two brothers. She will return to the hospital as an outpatient and our therapies team will continue to work with her at home to supervise her onward care.”

She is due to return to hospital in a few weeks for cranial reconstructive surgery.

Daughter of Yuko Ikeda kidnapped to ransom in Tokyo; freed 13 hours later

Ikeda Kanako, a 21-year-old senior student of the Meiji Gakuin University and the first daughter of celebrity surgeon Yuko Ikeda, was kidnapped at about 1225 (UTC+9), June 26, 2006, in Shibuya, Tokyo.

A bullet was fired and one officer slightly cut when police stormed a Kawasaki apartment to rescue the girl.

Kanako was dressed in a white light half-sleeved cardigan, blue jeans with a bistre belt made of leather, a spring green camisole and carried a bag of Vuitton when she was abducted at a bus stop.

She was found unharmed 13 hours later by Japanese police at a condominium located in Nakahara-ku, Kawasaki, Kanagawa. The young woman’s make-up was not disordered; Kanako’s long brown fringe was not disheveled at all and she was wearing what she had been when she was kidnapped.

The kidnapping of Kanako was a big story in Japanese media in June, 2006. The story appeared in many newspapers as the front-page news on June 27, 2006.

Kanako and her kidnappers had been in touch with her mother using Kanako’s mobile phone. The effort to free her was helped greatly by a woman who witnessed the moment Kanako was taken; she wrote down the license plate of the van and other details.

Police traced mobile phone calls and were able to locate the van in Kawasaki where they detained two of the kidnappers as they went shopping.

One conspirator Li Yong, 29, from China, led the policemen to the apartment and tricked Kaneo Ito, 49, from Japan, to open the door. Ito managed to discharge one bullet before being restrained by an assistant police inspector, the first man in the room.

The other man involved in the kidnap of Kanako was Choi Gi Ho, 54, from South Korea. Kanato was freed unharmed.

The Tokyo Metropolitan Police Department arrested three men on suspicion of conspiring to kidnap a woman and hold her to a reported 300 million yen ransom.

Suzy VanstrusenBefore filing for bankruptcy, you have to know the different kinds of it for you to be able to tell which category you qualify. The categories are created to specifically correspond to an individual’s situation. Years ago, a person can declare bankruptcy and choose from the categories. But since there is a new amendment beginning October 17, 1995 in the Bankruptcy Law that governs the US, there are slight changes when filing for bankruptcy.

Today, a person cannot make a decision on his own. Bankruptcy chapters 7 and 13 particularly are now accompanied by certain qualifications that the individual needs to pass. This is called the means calculation. In this test, the expenses will be subtracted from the monthly income of the individual. The result will then be multiplied by 60 (a fixed number) in order to determine whether he or she will be eligible for a Chapter 7 or Chapter 13 bankruptcy.

Chapter 7 bankruptcy gives the individual freedom from all charges in his account. This is discharging a person completely from all the debts he has. If the result of your means test calculation shows that you will not be capable to pay off your debts, then you will be qualified to declare Chapter 7 bankruptcy.

If your means test calculation results to at least $6,000 and above, you are then ordered to file for Chapter 13 bankruptcy. Under Chapter 13, you are required by the law to pay your debts by submitting at least 10% of your monthly salary. However, you are allowed to maintain ownership of your properties.

Other kinds of bankruptcy are the Chapter 9, 11 and 12 bankruptcies. Chapter 9 is a bankruptcy provision intended for municipalities or public agencies. This can be considered as the most complicated category since it involves a large group of people.

Chapter 11 is a bankruptcy proceeding done by business corporations. No bankruptcy trustee will be designate to decide on a Chapter 11 case. The corporation that filed for bankruptcy will have to create a recovery plan on its own.

Chapter 12 bankruptcy is for family farmers and fishermen. Filing for a Chapter 12 bankruptcy protects a farmer or a fisherman from losing his assets to his creditors. With this, he will only be required to pay his debts through his salary.

Generally, the new bankruptcy law requires everyone to undergo credit counseling under a credit counseling agency accredited by the government. This must be done at least six months before they file for bankruptcy. The credit counseling agency will take a look at the individual’s debt problem and try to find solutions other than bankruptcy. If the credit counseling agency recommends filing for bankruptcy, that’s the only time the application can be started.

The individual should then find a bankruptcy attorney who will prepare the bankruptcy documents and who will be representing him in the bankruptcy court. After bankruptcy has been filed, the bankruptcy judge will be the one to seal the approval for the discharge.

This year Israel turns sixty and it has embarked upon a campaign to celebrate its birthday. Along with technology writers for Slate, PC Magazine, USA Today, BusinessWeek, Aviation Weekly, Wikinews was invited by the America-Israel Friendship League and the Israeli Foreign Ministry to review Israel’s technology sector. It’s part of an effort to ‘re-brand the country’ to show America that there is more to Israel than the Palestinian conflict. On this trip we saw the people who gave us the Pentium processor and Instant Messaging. The schedule was hectic: 12-14 hours a day were spent doing everything from trips to the Weizmann Institute to dinner with Yossi Vardi.

On Thursday, the fifth day of the junket, David Saranga of the foreign ministry was able to arrange an exclusive interview for David Shankbone with the President of Israel, Nobel Peace Prize recipient Shimon Peres. For over an hour they spoke about Iranian politics, whether Israel is in danger of being side-lined in Middle Eastern importance because of Arab oil wealth, and his thoughts against those who say Israeli culture is in a state of decay.

The only crime I committed was to be a little bit ahead of time. And if this is the reason for being controversial, maybe the reason is better than the result.

Shimon Peres spent his early days on kibbutz, a bygone socialist era of Israel. In 1953, at the age of 29, Peres became the youngest ever Director General of the Ministry of Defense. Forty years later it was Peres who secretly gave the green light for dialogue with Yassir Arafat, of the verboten Palestine Liberation Organization. It was still official Israeli policy to not speak with the PLO. Peres shares a Nobel Peace Prize with Yitzak Rabin and Arafat for orchestrating what eventually became the Oslo Accords. The “roadmap” that came out of Oslo remains the official Israeli (and American) policy for peace in the Palestinian conflict. Although the majority of Israeli people supported the plans, land for peace was met with a small but fiery resistance in Israel. For negotiating with Arafat, former Prime Minister Benjamin Netanyahu shouted at Peres, “You are worse than Chamberlain!” a reference to Hitler’s British appeaser. It was during this time of heated exchanges in the 1990s that Yitzhak Rabin was assassinated by Yigal Amir, a Jew who thought it against Halakhic law to give up land given by God (Hashem).

Peres is the elder statesman of Israeli politics, but he remembers that he has not always been as popular as he is today. “Popularity is like perfume: nice to smell, dangerous to drink,” said Peres. “You don’t drink it.” The search for popularity, he goes on to say, will kill a person who has an idea against the status quo.

Oil spill reported in Gulf of Mexico

At least 21,000 gallons of crude oil has spilled into the Gulf of Mexico near the United States mainland coast, about 30 miles off the shore of Galveston, Texas. The U.S. Coast Guard says that oil is still leaking at a rate of 80 to 400 gallons a day.

The High Island Pipeline began to leak on Sunday and was immediately shut down when a pressure loss was detected. The pipeline is owned by Plains All American Pipeline who state that the incident is “under investigation” and that officials are working to “minimize the impact of the incident.”

“A medium crude oil pipeline ruptured 30 miles southeast of Galveston, Texas, and leaked approximately 21,000 gallons of oil into the Gulf of Mexico Sunday, December 24,” said a press release by Coast Guard.

“There’s a 60-yard-wide oil sheen that extends for about half a mile. It is still leaking slowly, about 80 to 400 gallons a day,” added the Coast Guard.

Reports say that the oil is traveling away from any shoreline and that remaining oil is being suctioned out of the pipeline. Ships in the area have not been diverted.

“All appropriate agencies have been notified. Plains, the U.S. Coast Guard, and the Texas General Land Office are working within a unified command system consisting of Federal and state agencies and oil spill response organizations to manage and mitigate this incident. In addition, Plains has activated its spill response plan to contain and clean up the spill. At present, Plains has mobilized Airborne Support, Inc., Clean Gulf Associates and other additional resources in an effort to minimize the consequences of the incident,” said a press release by the Plains oil company.

So far, no injuries have been reported.
